The International Humanitarian Fact-Finding Commission present
as an observer at the 28th International Conference of the Red Cross
and Red Crescent, in Geneva
The Commission is pleased to note that it received mention both
in Resolution 1 and in the Declaration of the 28th International
Conference. In these documents the International Conference invites
those States which have not yet done so to recognise the competence
of the Commission. The official documents of the 28th International

The Commission delegation took the opportunity offered by the Conference
to inform those present about its role and current activities at
a plenary session and in the first workshop, "International
Humanitarian Law and the Challenges Posed by Contemporary Conflicts".
It also organised a side-event at the Varembé Conference
Centre on 4 December for this purpose.
It distributed its new brochure to all delegations, and invited
several States which have not yet recognised the competence of the
IHFFC to participate in bilateral discussions on the Commission's
recent activities and developments.
The Commission approached a number of African states to assess their
interest in IHL, in particular the Commission, in view of the promotional
missions it is to make to central and west Africa as well as to
southern and east Africa in the course of this year. The talks it
held with Latin-American countries served as follow-ups to the promotional
missions it made to Guatemala, El Salvador and Honduras in 2000
and to Venezuela and Ecuador in 2001. The Commission also held talks
with members of the French delegation. France, together with Estonia
and Latvia, are the only remaining countries of the 25-state European
Union not to have recognised the competence of the Commission.
The Commission noted with satisfaction the results of the Conference
as well as the positive response to its active participation in
the Conference.

28th International Conference of the Red Cross and Red
Crescent in Geneva
The IHFFC will participate at the 28th International Conference
as an observer. The following eight members of the IHFFC will attend
the conference: Sir Kenneth Keith (President), Dr. Ghalib Djilali
(1st Vice-President), Amb. Juan Antonio Yanez-Barnuevo (2nd Vice-President),
Dr. Elzbieta Mikos-Skuza (3rd Vice-President), Prof. Michael Bothe,
Prof. Stelios Perrakis, Amb. Arpad Prandler and Major-General Anthony
Rogers.
The members of the IHFFC will use this opportunity to inform the
participants of the Conference about the IHFFC's function and current
activities in the plenary and during a side-event, which will be
organised by the Commission on 4 December 2003 at 12:15 in the Varembé
Conference Center. It has further invited several States which have
not yet accepted the competence of the IHFFC to discuss its activities
and recent developments on a bilateral basis.
The importance of the role of the Commission was already noted
at the 27th International Conference of the Red Cross and Red Crescent.
The Conference called on States Parties to the first Protocol which
had not yet accepted the competence of the Commission to reconsider
their position. Parties to armed conflicts were also asked to make
a systematic examination of the use of, and the possibility of resorting
to the Commission to clarify facts or facilitate respect for international
humanitarian law through its good offices. Draft Resolution 1 of
28th International Conference basically reiterates this call.
The 28th International Conference will bring together the 190
States Parties to the Geneva Conventions, the 179 Red Cross and
Red Crescent National Societies, the International Committee of
the Red Cross, the International Federation of Red Cross and Red
Crescent Societies and a number of observers to discuss issues of
common humanitarian concern relating to the theme of protecting
human dignity.

Mali recognises the competence of the IHFFC
The Government of the Republic of Mali has recognised the competence
of the IHFFC on 9 May 2003. The Republic of Mali is the 65th State
to have done so.

Non-Governmental Experts, 19 –21 February 2003, Geneva:
The Missing
An international conference convened by the International
Committee of the Red Cross (ICRC) ended today with a strong call
for action to clarify the fate of people missing as a result of
armed conflict and internal violence and to support their families.
The recommendations adopted by the conference also aim at protecting
persons from going missing.
The conference brought about a heightened awareness
of this tragedy and provided a renewed impetus for efforts that
need to be made by all those responsible for addressing the problem
of the missing and their families. It brought together over 350
governmental and non-governmental experts from more than 90 countries,
including representatives of families of the missing.

64 States have regognised the Competence of
the Commission
Since October 2002, the following four States have
recognised the Commission's Competence:
- Cyprus: 14 October 2002
- Cook Islands: 07 November 2002
- Democratic Republic of the Congo: 12 December 2002
- Kingdom of Tonga: 20 January 2003
There are now 64 States having recognised the Competence
of the International Humanitarian Fact Finding Commission.

Participation in the first session of the Assembly of the States
Parties to the ICC
The International Humanitarian Fact-Finding Commission has been
invited by the UN Secretary-General to participate in the session
of the Assembly of States Parties concerning the International Criminal
Court, which will take place from 3 to 10 September in New York.
Hon. Justice Sir Kenneth Keith, New Zealand, and Prof. Michael Bothe,
Germany, will represent the IHFFC at this session.

New constitution of the International Humanitarian Fact-Finding Commission
The
International Humanitarian Fact-Finding Commission held its 13th
annual meeting on 18 February 2002 in Geneva. It was the first meeting
since the election of its new members, which took place during the
diplomatic conference in November 2001.

International Humanitarian Fact-Finding Commission: election of
members
Switzerland
has convened a diplomatic conference for the purpose of electing
the 15 members of the Commission. The 58 States Parties to Additional
Protocol I of 1977 to the 1949 Geneva Conventions which have recognised
the competence of the Commission were invited to attend the Conference.
20 people presented their candidatures and 49 States Parties were
represented at the conference.

Yugoslavia recognises the competence of the IHFFC
On
16 October 2001, the Federal Republic of Yugoslavia submitted a
declaration of succession with respect to the four Geneva Conventions
and their Additional Protocols without reservation. The declaration
comes into force with retroactive effect as of 27 April 1992.
The Federal Republic of Yugoslavia also made a declaration concerning
recognition of the International Humanitarian Fact-Finding Commission,
in conformity with article 90 of the Additional Protocol I, with
effect as of 16 October 2001.

Trinidad and Tobago recognises the competence of the IHFFC
On
22 July 2001, the Government of the Republic of Trinidad and Tobago
recognised the competence of the International Humanitarian Fact-Finding
Commission, becoming the 59th State to do so. Additional Protocol
I to the Geneva Conventions of 12 August 1949 will enter into force
for Trinidad and Tobago on 20 January 2002.

Ireland
recognises the competence of the IHFFC
The Governement of Ireland has declared on 19
May 1999 that it recognises the competence of the IHFFC. Ireland
becomes the 55th State to have made the declaration provided for
by Article 90 of Additional Protocol I to the Geneva Conventions
of 12 August 1949. Ireland is also the 14th Member of the European
Union to recognises the competence of the Commission.

The United Kingdom recognises the competence
of the IHFFC
The Governement of the United Kingdom of Great
Britain and Northern Ireland has declared on 17 May 1999 that it
recognises the competence of the IHFFC. The UK is the 54th State
to have done so; it is also the second permanent Member of the UN
Security Council (after Russia) and the 13th Member of the European
Union to make the declaration of Article 90 of Additional Protocol
I to the Geneva Conventions of 12 August 1949.

15 February
Nomination of a new Member
Pursuant to Article 90, Paragraph 1(e), of Protocol
I, the Commission has appointed Dr Awatif Ali Abuhaliga as its new
Member in replacement of the late Judge Skarstedt during its Annual
Meeting held from 14 to 16 February 1999 in Geneva. Dr Abuhaliga
is the first lady to become a Member of the Commission.
Dr Abuhaliga is a physician and is currently
a Director at the United Arab Emirates Ministry of Health.

Judge Skarstedt is dead
The Secretariat regrets to inform that the Member
of the International Fact-Finding Commission, the former President
of the Swedish Court of Appeal, Dr Carl-Ivar Skarstedt, has passed
away at the age of 68. Judge Skartedt was elected in 1991.

The International Humanitarian Fact-Finding Commission,
IHFFC, has launched its web site today in Berne.
